Principles of personal data protection processing

The Controller is entitled to request proof of your identity in order to prevent unauthorized access to your personal data.

The Controller did not appoint a data protection officer.

Legal basis for the processing of personal data

HUTIRA BRNO processes personal data in accordance with European Union law, especially in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter “GDPR”) and national legislation, in particular Act No. 110/2019 Coll., on the Processing of Personal Data (hereinafter referred to as “ZZOU”) and Act No. 480/2004 Coll., on Certain Information Society and Analysis Services, as amended.

The legal reason for processing your personal data is:

  • the fact that such processing is required for the execution of a contract between you and the Controller, or for the implementation of measures prior to the conclusion of such a contract within the meaning of Article (6)(1)(b) of the GDPR, or
  • in the case of realisation of the legitimate interests of the Controller, or
  • if you give your consent to the processing of your personal data.

In the event of a contractual relationship, the Controller sends its business partners and customers a business message about news, products, discounts, benefits and current events at the company HUTIRA – BRNO (hereinafter also “Hutira News”), due to the realisation of the legitimate interests of HUTIRA BRNO in the form of limited direct marketing. In each e-mail message with Hutira News, the Controller allows you to unsubscribe from Hutira News at any time, or allows you to object to such processing.

The Controller uses cookies on its website www.hutira.cz, i.e. data on visits to this website. Processing is solely possible on the basis of your consent to the use of the relevant cookies.

Scope of your personal data processing

The Controller will process the personal data provided by you, namely your name, surname, e-mail address, and/or telephone number, organisation name, job position and other personal data that you provide to the Controller to this extent during your registration in the “partner section” of the Controller’s website www.hutira.cz, or obtained from you when concluding the contract or granting consent to processing.

Purpose of processing your personal data

The Controller processes your personal data in connection with the sale of goods and the sending of Hutira News under the conditions and within the limits set by the applicable legislation, especially in accordance with the provisions of Article (6)(1)(a) and (b) and (f) of the GDPR, and furthermore within the meaning of Act No. 480/2004 Coll., on Certain Information Society and Analysis Services, as amended, for the following purposes:

  • contacting and providing information requested by the data subject (name, surname, e-mail address),
  • fulfilment of the contractual obligation or carrying out measures before concluding such a contract (name, surname, name of the organisation, job position, e-mail address, and/or address, telephone number),
  • database management for direct marketing (name, surname, e-mail address), direct marketing (name, surname, e-mail address),
  • registration of a new partner in the “partner section” on the Controller’s website www.hutira.cz (name, surname, email address)

If you have enabled the storage of cookies in your browser and you agree to their use, we obtain data on visits to the website. You can also set your browser to not accept any cookies.

The period for which we will process your personal data

The Controller will process your personal data for the time necessary to ensure mutual rights and obligations arising from the contractual relationship, i.e. for the entire period of the performance of the contract, or for as long as the legitimate interest is present.

Hutira News is sent for the entire period of time, as long as consent to its sending lasts, or for the entire period when the legitimate interest of the Controller is given, until unsubscribing to them, or until an objection is raised against the processing of personal data for this purpose. If consent is given, Hutira News is sent (and personal data processed) for a maximum of 10 years. The Controller will then request consent again.

Additional processing of personal data beyond the scope of the above is performed only if it is necessary for the fulfilment of obligations arising from legal regulations that apply to HUTIRA – BRNO.

As soon as the purpose of the processing has ceased or the Controller no longer has any legal reason for the processing of personal data, the Controller shall delete the personal data.

Persons who have access to your personal data

The Controller and its employees will have access to your personal data. We do not share your personal information with third parties. This does not affect the legal obligations of the Controller or its defence in court.

Your rights under the GDPR

You have the right, without the risk of any sanction or disadvantage, to withdraw your consent at any time, request the correction or deletion of personal data and/or supplement personal data, request processing restrictions, raise an objection or complaint against personal data processing, request data transfer, request access to your personal data, by notification to the electronic address info@hutira.cz. You also have the right to delete personal data if the personal data is no longer needed for the purpose of processing, or if you have revoked your consent to its processing, objected to the processing of personal data and there are no prevailing legitimate reasons for processing. You also have the right to be informed about breaches of personal data security, its deletion and other rights set out in the GDPR.

The right to object

You have the right to object to the processing of your personal data if it concerns you on the basis of Article (6)(1)(f) of the GDPR (processing is necessary for the purposes of the Controller’s legitimate interests). An objection can be submitted to the Controller. In the event that you object, the Controller will not continue to process your personal data to this extent, unless it demonstrates serious legitimate reasons for the processing which outweigh your interests or rights and freedoms or for the determination, exercise or defence of legal claims. In the case of processing personal data for the purposes of direct marketing, you have the right to object at any time to the processing of personal data concerning you for marketing. In this case, personal data will no longer be processed for this purpose. More detailed information on this right is contained in particular in Article 21 of the GDPR.

The right to lodge a complaint with the supervisory authority

You have the right to lodge a complaint concerning the processing of your personal data or the failure of the Controller to comply with the obligations arising from the GDPR to the supervisory authority. The competent supervisory authority in the Czech Republic is the Office for Personal Data Protection with its registered office in Pplk. Sochora 27, 170 00 Prague 7, www.uoou.cz.

The obligation to provide personal data and the consequences of not providing it

You provide your personal data to the Controller completely voluntarily and it is at your discretion whether you want to enter into an agreement with the Controller, subscribe to Hutira News or log in to the partner section on the website www.hutira.cz. You have no obligation to provide personal data, and if you do not provide it, you will not be penalized. However, if you do not provide personal data, the Controller will not send you the Hutira News in particular and you will not have access to the partner section.

Safety

The personal data of the data subject is secured by the Controller through the set technical and organizational measures.

Access to this personal data by employees of the Controller is protected by a password and firewall.

If the Controller has provided you (or you have chosen a password) that allows you to access certain parts of the Controller’s website, you are responsible for maintaining the confidentiality of that password. You must not share your credentials with anyone else and you authorize the Controller to act on instructions and information from any person who enters your credentials.
